The National Court confirms the dismissal of the case against Galán in the 'Villarejo case'

The Criminal Chamber has now dismissed the appeal filed by the chairman of ACS, Florentino Pérez, which was also joined by Podemos and Corneliu Dica, Iberdrola's former partner in a project in Romania who was allegedly spied on by retired commissioner José Manuel Villarejo.

The Criminal Chamber of the Audiencia Nacional (AN) has confirmed the closure of the 'Villarejo case' for the president of Iberdrola, Ignacio Sánchez Galán, which was decreed by the examining magistrate on the grounds that the facts for which he was being investigated in the 'Tándem' macro-case would be time-barred.

This is a free dismissal which, according to article 637 of the Criminal Procedure Act, will proceed with a free dismissal because there is no rational evidence of having perpetrated the act that gave rise to the formation of the case, nor anything that has been constituting a crime and therefore those who were going to prosecute are completely exempt from criminal responsibility.

In an order on Thursday, the judges of the Third Section point out that the statute of limitations for the crime of bribery is 10 years, a period that would have ended in June 2021, the month in which the head of the Central Court of Instruction Number 6 charged Sánchez Galán. And, they add, the facts for which he was summoned occurred between 2004 and 2009.

It was on 23 June last when Judge Manuel García Castellón ordered the dismissal of Sánchez Galán due to the prescription of the facts for which he was accused of active bribery, against privacy and falsification of commercial documents.
