The prosecutor's appeal against Judge García-Castellón's ruling, which ordered the dismissal of the case against the Iberdrola chairman, is dismissed

There was no evidence to charge Galán in the Villarejo case, as confirmed by the National Court

There was no evidence of any crime to charge Ignacio Sánchez Galán, chairman of Iberdrola, in the case opened for an alleged assignment to Commissioner Villarejo.

The Criminal Chamber of the Audiencia Nacional has rejected the prosecutor's appeal against the order of the Court of Instruction No. 6, which on 23 June had agreed to dismiss the case investigating Ignacio Sánchez Galán, chairman of Iberdrola, for allegedly commissioning Commissioner José Manuel Villarejo to carry out espionage.

This case, known as 'Wind', was opened to investigate whether Iberdrola had commissioned Cenyt, Villarejo's company, to investigate a company with which the Basque electricity company had certain conflicts after forming an alliance for a project in Romania.

Magistrate Manuel García-Castellón dismissed the case against Galán. The prosecutor appealed, disagreeing, but the Criminal Chamber of the Audiencia Nacional has ratified García-Castellón's decision.

The ruling emphasises that the mere fact of being chairman of Iberdrola is "clearly insufficient as an incriminating element [...], even at the circumstantial level of this procedural phase", to attribute to Ignacio Sánchez Galán "a participation in the allegedly criminal acts under investigation".

The magistrates consider that holding the position of president of Iberdrola España - on which Iberdrola Renovables Energía depended - "says nothing, especially in large companies such as those referred to here, about involvement in or knowledge of the punishable acts".

From the investigation into the case, including the testimony of Sánchez Galán as a defendant, "no element has emerged that connects him to the facts relating to the Wind project".

The prosecutor insisted on pointing out that Sánchez Galán was chairman of Iberdrola, but the National Court considers that he did not provide any other arguments, "thereby highlighting the clear imbalance with respect to the evidence that supported the imputation of Ignacio Sánchez Galán with regard to the facts concerning the other projects".
