Jadiyetu el Mokhtar lost his trial at the Peruvian Constitutional Court
The Constitutional Court of Peru declared unfounded the habeas corpus filed by Jadiyetu el Mokhtar, alleged "ambassador" of the Rasd, who was expelled from Peru in September 2017.
The Constitutional Court of Peru has just issued its final verdict on the case of Jadiyetu el Mokhtar, a Spanish citizen with tourist status who was expelled from Peru in September 2017 for usurpation of diplomatic functions on behalf of a fictitious entity called the Sahrawi Arab Democratic Republic -Rasd, which Peru has not recognised since 1996.
With this historic decision, the Peruvian justice system categorically rejected the appeal presented by the separatist's defence, following her expulsion and the registration of an immigration alert to prevent her from entering Peruvian territory issued against her for infringing the country's immigration laws.
The Court's decision was adopted unanimously by the seven magistrates of the judicial body, who declared the habeas corpus petition unfounded.
The appeal that Jadiyetu el Mokhtar's defence had filed against the Director General of Migration and Naturalisation of the Ministry of Interior, the officials of the Directorate General of Migration and Naturalisation of the Ministry of Interior and the Chancellor of the Republic of Peru, was initiated on 9 September 2017.
By virtue of this ruling, the usurper of ambassadorial functions, Jadiyetu el Mokhtar, is now subject to a ban on entry into Peruvian territory, and her example should be taken into consideration in other countries in the region so that other representatives of this group do not seek to pass themselves off as ambassadors and representatives of a country that does not exist.
The TC ruling is a great achievement for the sovereignty of Peru, which is not even considering re-establishing diplomatic relations with the Rasd, according to a statement issued by the Foreign Ministry on 27 September 2017.
Having the status of tourist, the Spanish citizen illegally presented herself before the high authorities of Peru and participated in various public events and political activities -interfering in internal affairs-, claiming the status of ambassador of an illusory entity in Peru, a position that she does not hold, for which she would have acted against public order and internal order and contravened all the immigration laws of the country.
So far, neither the Polisario Front nor the Rasd have officially pronounced themselves on this ruling, nor previously on the expulsion of their alleged ambassador.
