Concern about the situation of fundamental rights in Pakistan
Mubarak Ahmad Sani, an Ahmadi accused of blasphemy (case 661/22, December 6, 2022) sentenced to life imprisonment for teaching the Holy Quran
The Ahmadiyya Muslim Community wishes to convey to the Spanish public and institutions its deep concern about the case of Mubarak Ahmad Sani, a Pakistani citizen and member of this Ahmadi Muslim religious minority, who is currently involved in legal proceedings that raise serious questions about respect for the rule of law and fundamental rights in Pakistan.
Mubarak Ahmad Sani was arrested in January 2023 for educational activities carried out in the private sphere of our religious institution, following an award ceremony for students who had memorized the Holy Quran. After more than a year of imprisonment, in February 2024 the Supreme Court of Pakistan granted him bail and overturned key charges in the case, reaffirming basic constitutional principles relating to freedom of conscience and the private practice of religion by minorities.
However, this court decision triggered intense social and political pressure from religious extremist groups, accompanied by hate speech and episodes of violence against members of the Ahmadiyya community. Subsequently, lower courts handed down an extremely severe sentence against Mr. Sani, raising serious concerns about judicial independence and legal certainty.
In a critical development on December 24, 2025, the Additional Sessions Judge of Lalian handed down a guilty verdict against Mubarak Sani Sahib. He has been sentenced to life imprisonment under Section 295-B of the Pakistan Penal Code and to three years' imprisonment under Section 298-C of the same code.
This case reflects a structural situation of vulnerability for religious minorities in Pakistan and highlights the need to guarantee, in accordance with international law and constitutional principles, the effective protection of religious freedom, equality before the law, and human dignity.
